In regard to this, the company's activity consists of identifying, within Europe, Parachute Centres; Parachute Companies, instructors and free-lance para-professionnals (A.K.A. parachute jump professionnals)recognized by the customer as the unique organizer for finalization of the parachute jump whether it is for the customer or for a third person.

QG COM Corp. is independant of the parachute professionnals mentionned above, who stand for their own interest and have an exclusive responsability on their acts.

Precisely, QGCOM Corp. :

The specifications above constitute the only law between partie, except for legal or reglementary public clauses.

They apply by right as soon as a parachute jump is subscribed by the Customer – possibly supplied with a Video option– after online reservation on www.whatajump.com.

Eventually, the Customer is fully informed that parachute jumping is an extreme sport,involving a risk of injury or death and for which QGCOM Corp. – regarding the firm's activity and the present contract – cannot be blamed in any way.

QGCOM Ltd also reminds you that 4000m.com is only a brand name, which shall not be considered contractual regarding jumps height. The latter may vary between 3000 and 4200 meters according to locations, authorizations and decisions of the Air Authorities and of the para-professionnals.

ARTICLE I – OBJECT OF THE CONTRACT :

Within the context of the website whatajump.com, QGCOM Ltd's role is to make contact –via a booking – the subscriber Customer and a parachute Center and/or identified tandem pilots so completion of the parachute jump.

ARTICLE II – DETERMINATION OF THE CONTRACT :

The contract is concluded when the Customer completes the booking and send the subscription by email,online or by correspondance but will definitely take effect at the receipt of the settlement for the service.

ARTICLE III – QGCOM LTD'S COMMITMENTS :

1 / Obligations linked directly to the object of the contract :

At the receipt of your order, QGCOM Ltd. will notify by email the instructors/pilot and/or parachute centres likely to respond favourably to the booking of a jump for the customer.An online booking by an internet user for a fixed date, non prior to a written request followed by a positive reply from QGCOM,does not guarantee the possibility of the jump on the chosen date. The customer acknowledges that a date or a place can be amended later by the provider for many reasons including the weather, authorisations,crowds or any other reason evoked by the provider.

Then, QCCOM Ltd,before the confirmation of the date or site, will send the roadmap/itinerary to the Customer - subject to the payment - including useful information.

2 / Obligation of information :

FYI,we remind you that the organisation of a parachute jump is subject to constraints typical to the distinctive features of this activity and which are not under the responsibility of QGCOM Ltd.

As a consequence, the time of the jump, the altitude and any other variable and/or unpredictable benchmark linked to the practice are for reference only.

The customer is fully informed that the trip to the Parachute centre/ Dropzone can turn out to last more than the anticipated period, due to weather conditions in particular and/or reasons related to the organisation of the centre.Out of precaution, the Customer should plan half a day or even a whole day to do the jump, and the customer agrees to that clause without reserve.

In addition,the provider could change the date and/or site, for some reasons related to to the organisation of the activity,which the customer agrees to without reserve. The amendment of the date, time or site of the jump is external to the interference of QGCOM Ltd and in that event the customer will be notified by the instructor/pilot/parachute centre staff.

ARTICLE IV – CUSTOMERS' COMMITMENTS :

Indent 1 : The customer is committed to pay QGCOM Ltd the price for the service of of connection with the parachute professional corresponding to the amount specified at the the time of booking.

Indent 2 : The choice to offer a parachute jump to a third person rests with the customers' exclusive responsibility.He/she'll make sure of the suitable physical condition of the jumper required for a skydive/parachute jump.He /she'll hand these Terms and Conditions before tthe jump.

Indent 3 : The refusal to jump for a reason or another does not allow the Customer to get a refund unless he/she can justify a breach of trust from QGCOM.

ARTICLE V – QGCOM LTD'S LIABILITY :

QGCOM Ltd is commited to honour the service of BOOKING made for the Customer with the parachute professionals.

QGCOM Ltd shall no be liable for a potential default of a parachute professional as long as it does not interfere directly or indirectly with the organisation of the parachute jump (the choice of instructors, pilots, equipment, aircrafts,...lies with the parachute professionals, adept in the practice of this activity and able to implement the rules and use the equipment decreed by laws and regulations).

Finally, if the Customer chose the Video option, QGCOM shall no be liable for the correct execution of this service. If a litigation arose about the Copyrights and Soundtrack or any other subject, the Customer will blame the cameraman in case of breach of trust. QGCOM has no control over the use and destination of the visual aid or any part of the movie.

ARTICLE VI – QGCOM'S LIMITS OF LIABILITY :

In case of failure or fault during the booking service, the Customer is not entitled to claim to QGCOM Ltd and /or Mr Jacques Marsily the compensation of the damage endured for an amount higher than the said service.

ARTICLE VII – POSTPONEMENT – CANCELLATION :

1 - The Customer can postpone the parachute jump notifying the decision to QGCOM Ltd and to the provider 8 days before the date of the jump at the latest by email ( with request of receipt) or by fax :+33 1 4278 8531. if not, there will be no refund at all, whether the Customer makes the jump or not.

If the notification occurs within this delay, the Customer will offer another date (at no extra charge) that will have to be within 1 year of the subscription,QGCOM Ltd keeping the amount of the jump during this time. No other postponement will be accepted after a new date is fixed.

2 - In case of cancellation decided by the Customer for a reason not imputable to QGCOM Ltd, there will be no refund.

3 – The potential decision of the Parachute Professional to postpone the time and/or date, to amend the site or to cancel the jump cannot be a motive of refund of the service performed by QGCOM Ltd. The same rule applies if the Customer refuses, on the premises, to jump for a reason of potential change of time,site,jump or another motive.

ARTICLE VIII – INSURANCES :

QGCOM Ltd is not a Parachute Centre, an aircraft carrier and therefore did not take out insurance other than the one linked to their intermediation activity. The Customer is fully informed that in case of disaster; the Parachute Professional took out the required insurance policy. It is also the Customer's duty to take out a personnal insurance if he wishes to relative to the activity.

ARTICLE IX - LITIGATIONS

In case of conflict connected to the training, the performance, the resolution or the cancellation of the said contract, the conflict will be subject to the jurisdiction under the territorial expertise of PARIS even in case of respondent's plurality.
